1. Introduction and Acceptance of Terms

Welcome to NhanEX.com ("NhanEX", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website, mobile application, and money transfer services (collectively, the "Services"). NhanEX is a Money Services Business (MSB) operated by NHAN ENTERPRISES (EIN: 42-3793684), a California corporation. By using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

2. Our Services

NhanEX provides money transmission and currency exchange services, primarily facilitating the transfer of funds from the United States to Vietnam. Our Services allow you to initiate transactions to send money to designated recipients. As a licensed money transmitter, we are required to comply with all applicable federal and state laws, including the Bank Secrecy Act (BSA) and California's Money Transmission Act .

3. Account Creation and Security

To use our Services, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use or security breach

We reserve the right to suspend or terminate your account if we suspect any unauthorized or fraudulent activity .

4. Identity Verification and Transaction Tiers

NhanEX operates a Tiered Know Your Customer (KYC) program to balance user experience with legal compliance. The following tiers apply:

Tier 1 (Basic)

  • Monthly Transaction Limit: Under $1,000
  • Required Information: Full legal name, phone number, email and address

Tier 2 (Enhanced)

  • Monthly Transaction Limit: $1,000 or more
  • Required Information: Full legal name, phone number, email address, date of birth, residential address, government-issued ID
  • Verification: Full identity verification through government-issued ID document

You will be prompted to upgrade to Tier 2 once your monthly transaction volume reaches $1,000. We reserve the right to require enhanced verification for any transaction we deem suspicious or high-risk, regardless of amount .

5. Fees and Exchange Rates

All applicable fees, exchange rates, and transaction limits will be disclosed to you prior to completing a transaction. Fees may include:

  • Service fees charged by NhanEX
  • Intermediary bank fees (if applicable)
  • Receiving bank fees (if applicable)

We reserve the right to modify fees and exchange rates at any time, with notice provided as required by law .

6. User Obligations and Prohibited Uses

By using our Services, you represent and warrant that:

  • You are at least 18 years old and have the legal capacity to enter into these Terms
  • All information you provide is true, accurate, and complete
  • You are the lawful owner of the funds being transferred
  • You are not using the Services for any illegal activity

Prohibited Activities

You may not use our Services for:

  • Money laundering, terrorist financing, or any activity violating U.S. or international sanctions
  • Fraud, scams, or deceptive practices
  • Transactions involving illegal goods or services
  • Structuring transactions to avoid reporting requirements
  • Any activity that would cause us to violate our legal obligations as an MSB

7. Compliance with Anti-Money Laundering (AML) Laws

NhanEX is a registered Money Services Business and is committed to full compliance with the Bank Secrecy Act, the USA PATRIOT Act, and all applicable federal and state regulations . Our AML program includes:

  • Written policies and procedures
  • Designated AML Compliance Officer
  • Regular employee training
  • Independent testing and audits
  • Customer identification and verification (KYC)
  • Transaction monitoring and reporting
  • Recordkeeping and retention

As an MSB, we are required to file Suspicious Activity Reports (SARs) for transactions of $2,000 or more that we suspect involve illegal activity, money laundering, or terrorist financing . We may also be required to file Currency Transaction Reports (CTRs) for certain cash transactions.

Geographic Targeting Orders (GTOs): For MSBs operating in specific ZIP Codes in California (including portions of Imperial and San Diego Counties), additional reporting requirements apply for currency transactions exceeding $200 .

8. Recordkeeping and Data Retention

To comply with federal law (31 CFR 1010.410), we maintain records of:

  • Customer identification information (KYC records): Minimum 5 years after account closure
  • Transaction records: Minimum 5 years from transaction date
  • Suspicious Activity Reports (SARs): 5 years from filing date

9. Right to Refuse Service

We reserve the right to refuse, suspend, or terminate service to any customer or transaction at our sole discretion, including but not limited to:

  • Failure to provide required identification or information
  • Suspicion of money laundering, fraud, or other illegal activity
  • Violation of these Terms
  • Legal or regulatory requirements

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available." To the fullest extent permitted by law, NhanEX disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement .

11. Limitation of Liability

To the maximum extent permitted by law, NhanEX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to your use of our Services . Our total liability to you shall not exceed the amount of fees paid by you for the specific transaction giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless NhanEX, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, or expenses (including reasonable attorney fees) arising from:

  • Your breach of these Terms
  • Your violation of any law or regulation
  • Your use of our Services
  • Any transaction you initiate

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Dispute Resolution: Any dispute arising out of or relating to these Terms shall first be submitted to informal negotiation. If not resolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Orange County, California.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Services after such changes constitutes acceptance of the revised Terms.
